On November 14, 2020, a
federal district court held that Acting Secretary of the Department of Homeland Security (DHS), Chad F. Wolf was not lawfully serving as Acting Secretary when he issued the July 28, 2020 memorandum, which limited the provisions of the Deferred Action for Childhood Arrivals (DACA) program. As a result, the court ruled that the memorandum was invalid.
On December 7, 2020, the DHS issued a
DACA Update that stated the U.S. Citizenship and Immigration Services is doing the following:
“We want to acknowledge the tremendous challenges our undocumented, AB540 and Dreamer students have weathered this past year, as we grappled with the triple pandemics of COVID-19, financial crisis and racial injustice – and celebrate their persistence.
The latest federal court ruling to fully restore the Deferred Action for Childhood Arrivals program is positive news for Dreamers studying and working throughout the California State University.
As the nation’s largest and most diverse university in the United States, our support for a clear path forward to ensure undocumented students and employees are able to achieve their educational goals and continue their careers has never wavered.
Resources are available to assist students and employees who are now DACA-eligible. We encourage them to contact one of the legal providers for advice to complete or renew applications.” Luoluo Hong, Associate Vice Chancellor for Student Affairs & Enrollment Management
All CSU campuses have staff dedicated to assisting students who are undocumented and students from mixed-status families. In addition, employee assistance programs are available for employees. Students and employees needing assistance with any of the provisions above are encouraged to seek free direct legal assistance from providers located in the geographic region of their campus.

University leaders from the Chancellor's Office and all 23 campuses will continue to advocate with congressional representatives for a permanent solution to protect our Dreamers.
